The New Top 5 Sectors

Stocks highlighted in this article are: Panera Bread Company (PNRA), Rollins, Inc. (ROL), Tivo, Inc. (TIVO), Watson Wyatt Worldwide Co. (WW), The Hershey Company (HSY) and ICF International, Inc. (ICFI).

We've mentioned it here before, but it's worth saying again; nearly half of a stock's price movement is tied to the performance of its respective group (Sector and Industry). By definition, a strong Sector or strong Industry will have more of its companies moving higher than a weak Sector or weak Industry, because by definition, a Sector or Industry is simply a group of similar stocks. If the majority of stocks are going down in an industry, it can't be a strong industry. If more stocks are going up, it is a strong industry.

I've done some testing over the past and found that, oftentimes, just getting into an average stock in a strong group will often outperform the best stocks in a troubled group. This doesn't mean you can just pick anything and you'll make money. Far from it. But it illustrates how powerful the underlying group is to the success of your stock picking.

There are several ways you can define the best Sectors or Industries. One of my favorites is to look at the percentage of stocks trading within 10% of their 52-week highs. A lot of people like looking at the percentage price change over the last 12 or 24 weeks. And that's fine – but I don't think it is sensitive enough.

Take the Oil and Energy sector last year for instance. If you looked at it based on its 24-week or 12-week price performance – it was continuously ranked one of the top Sectors even while it was collapsing. That's because the gains were so large in the first part of the 12- or 24-week period – even a large pullback over a span of many weeks can be lost within the larger run-up that preceded it.

But by checking their position in comparison to their 52-week highs, a simple 10% pullback from their 52-week highs will show up. And if more and more companies within that group are pulling back from their highs by more than 10%, it'll be reflected in that Sector's rating and alert the investor that something systemic might be happening to that group as a whole rather than something that's just stock specific.

And like I said at the beginning, since roughly half of a stock's price performance can be directly attributed to the group that it's in, it's important to be able to identify the best Sectors quickly and accurately.

The top five Sectors based on the percentage of stocks at or within 10% of their 52 week highs are: 1. Retail-Wholesale - 14.23% 2. Construction - 8.24% 3. Consumer Discretionary - 7.95% 4. Finance - 7.92% 5. Consumer Staples - 7.61% (and an extra one for those who are not interested in Financials) 6. Business Services 7.32%

I should note too that the percentages are awfully small. Prior to last year, a Sector would typically need more than 50% of its stocks trading within 10% of their 52-week high to get into one of the top spots. These lower numbers are a reflection of the kind of market we're in. By the way, Oils-Energy are last at 2.82%.

Mutual funds go global...so can you!

Over the last few months there have been more than a handful of global fund launches and there are more in the pipeline. These funds invest in global stocks and/or mutual funds that invest in global markets. Here’s a look at what you must take into account when you invest in such funds …

The broad investment objective of global funds is to provide long-term capital appreciation by investing in securities from global markets or overseas mutual fund schemes that invest in diversified portfolios of securities, as prescribed by SEBI from time to time. With such funds investing in varied countries and economies, you now have the means to diversify your portfolio beyond the Indian equity market. More specifically, for investors who have already taken positions in local equities and are looking for diversification into other geographies, global funds could be just what they need. To an Indian investor, these funds have opened a window to international asset markets.

Types of global funds :

While the main benefit of investing in global funds is the diversification it has to offer by virtue of investing in overseas markets, sadly most of the global funds launched so far have mandated to invest at least 65 per cent of their assets in Indian equities. They choose to invest only up to 35 per cent in global equities.

This is done to ensure that the law accords them equity status from a taxation perspective. Global funds that invest a greater percentage of their assets in global share market cannot enjoy the tax benefits that equity funds are eligible for, i.e. tax free long term capital gains and a 10* per cent tax on short term gains. In the case of truly global funds (those that invest more than 35 per cent of their assets abroad), long-term gains are taxable at the rate of 10* per cent and short-term gains are taxable as per the slab rates applicable to the investor. However, remember that since diversification is the aim behind investing in global funds, and such funds are unlikely to occupy more than 10 per cent of your total portfolio, if you must diversify, do so regardless of the tax status of your investment. It is only then that your portfolio can actually reap the benefits of diversification.

Further, since most global funds are investing predominantly in emerging markets, investors express concerns about the basic purpose of diversification being defeated. Nevertheless, while India itself is an emerging market, other emerging markets are driven by different factors, opportunities and threats and therefore, behave differently from domestic markets although they all fall under the broad category of ‘emerging’ markets.

Tips to go : Lastly, choose your fund carefully. Study all the options that are available. Certain parameters that can be used to evaluate such funds are: the investment proposition offered by the fund, the fund’s investment processes, its long-term track record across market phases, especially the downturns and most importantly, compare it with other global funds of a similar nature. How to Trade Foreign Currencies With Market Participants

In the financial sector, the business of how to trade foreign currency has become one of the most promising and much sought after money-making endeavor. This is mostly because the business can give you immediate results depending on how much time you devote on it and what types of networks you have.

But getting into the foreign currency trading business requires you some thorough knowledge first before you get right down to it. You should first understand what it is and why there is a need to conduct such business. Foreign currency trading happens primarily because countries around the world have differing monetary values. If you look at it closely, you will realize that currency trading is really just as the name suggests-you swap your currency with that of another.

The world of foreign currency trading is very dynamic and involves different market participants. These participants are the people who are vital to making the entire business of foreign currency trading work. They involve all crucial aspects from both the private and public side. Each of these entities has a say in how currencies are exchanged and priced based from current market values:

1. Centralized Banks - These institutions are often tied up with the government. Some are even the main financial institutions in a particular country. Although they do not often directly buy or sell the currencies, they are still known to actively participate in the market. The main purpose of central banks is to provide a practical influence over the course of the trade. You can use these institutions to refer your current values and take advantage of low-priced currency trades as soon as they hit their values.

Collectors can be aggressive. There are those who do their job in an ethical and professional manner, but many in the collection industry are trained emotional terrorists who prey on consumer’s ignorance. You don’t have to be intimidated; there are many credit repair techniques that can help. In fact, if you take some time to understand your legal rights you may find that you can gain the upper hand and even profit from the situation.

Debt Validation

No one likes to get a collection letter, but it represents a credit repair opportunity. If you send a written response to the collector within thirty days of getting a collection letter you have the right to ask for proof of their legal right to collect the debt, as well as an accounting of the amount they claim is due. If they cannot provide the documentation they must cease collection efforts. This serves several valuable purposes. It will validate the legitimacy of the debt, eliminate expired and undocumented collections, and if the collection is valid you will have an accounting of the dollar amount owed.

Cease Communication Letters

If you wish to put an end to a collector’s phone calls you can send them a Cease Communication letter. Once they receive your letter they must stop contacting you, except to acknowledge receipt of your letter or to inform you that they are pursuing a legal remedy. This credit repair tactic should be used with care as many collectors respond by immediately sending the account to their legal department to evaluate other options like suing you.

The Attorney Solution

If you do not feel capable of handling collectors you should consult an attorney. Once you have an attorney who is willing to manage your collection issues you can quickly deflate all controlling collector communications. Once you inform a collector that you have an attorney they must ask you for the attorney’s contact information and stop contacting you. This credit repair strategy stops most manipulative collectors in their tracks as they simply won’t dare step over legal lines when dealing with an attorney. Many collectors will simply abandon their effort entirely.



Check Your Statute of Limitation

I
f a collection account has passed the statute of limitation (SOL) for collection through the court system collectors have no legal leverage. Over fifty percent of active collections are beyond the SOL. Research the SOL for every collection. If you are contacted by a collector about a collection that is beyond the SOL you can use a cease communication letter with no fear. If they sue you, you will have to appear in court to use your SOL defense, but you will prevail. It is important to note that the SOL clock starts with the original default date on the original collection, not the date that the collector reports the debt to the credit bureaus; SOLs have no bearing on reporting period limits and are almost always considerably shorter.

Credit Repair and Reporting Cures

It is vital to your credit repair effort to know that collectors buy and sell debt frequently. When a collector sells an account to another collector or sends it back to the original creditor they are supposed to withdraw the account from your credit report; this rarely happens. Collectors often let accounts continue to report after the account is sold. Examine your credit report carefully and challenge all questionable collections.

Tips For Choosing High-Performance Mutual Fund

Most people who invest in mutual funds don't know what they are doing. They take advice from someone at a bank or perhaps a friend and plunk down money into a fund. Sometimes this strategy works, but most of the time, it doesn't.

When you invest your money in a mutual fund, you are trusting someone to invest in the stock market for you. Because of this, you want to be sure this person knows what he or she is doing. Also, you want to make sure that this person is not charging you too much to manage your money for you. Mutual funds fees are "hidden," in the sense that they do not charge you an upfront fee but rather a percentage of the amount of money in your account. If this percentage is too high, you would do better just blindly picking stocks yourself



Here are five helpful tips for choosing the right mutual funds.

1. Keep the fees low. Generally, expense fees should not be much higher than 1% if it is just a basic domestic equity fund. You should never invest money in a fund that also charges a "load," which is an additional fee that is ridiculous to pay. Never invest in funds that charge loads; those funds are for suckers.

2. Check the asset base. Mutual fund managers only know of so many good investments. When they have too much money to manage, they begin investing in stocks they don't like much but need to invest in anyway or else they'll just have money laying around. There's little reason to invest in a fund with over $5 billion in assets. It's best if it's under $2 billion generally.

3. Consider an index fund. This is a fund that tracks a stock index, such as the S&P 500. For these funds, the manager just buys whatever stocks happen to be in the index. Since this is not much work, the fees are much lower. Even though this method is simple, it has proven to perform better than most mutual funds. Some high performance index funds include FSMKX (Fidelity S&P 500) and VIMSX (Vanguard S&P 400 Midcap.

4. Evaluate the fund's strategy. If you have a long term outlook, look for a more aggressive fund that invests in small-cap stocks, international stocks, and riskier stocks in general. High risk tends to result in high performance in the long run. If you are more risk-averse, consider an S&P 500 index fund.

5. Keep the fees low. Did I mention this already? Well, I'll mention it again. This is where most people mess up. Make sure you are not paying a load or paying too much in fees to the mutual fund.

Alternative Venture Finance: Federal Grants and Loans

While most companies seeking venture capital initially think about angel investors and venture capitalists, a large alternative source of financing is federal grants and loans. The two largest federal grant programs are run by the Small Business Administration (SBA), and by Small Business Investment Companies (SBICs).

An SBA loan, regardless of whether it is a direct loan from the SBA, or, as is more common, a bank loan guaranteed by the SBA, is essentially a bank loan. The benefit of it versus a traditional bank loan is the rate. SBA rates are typically much less than traditional business loan rates.

In most cases, in a guaranteed SBA bank loan, the SBA guarantees 90 percent of the loan will be repaid to the bank. As such, banks are at much less risk than in most other loans, and are a bit more flexible with regards to who they offer these loans. However, the SBA usually requires the founders of the company to personally guarantee the loans, which makes them risky should the venture collapse.


Alternatively, Small Business Investment Companies (SBICs) are privately organized corporations that are licensed and regulated by the SBA. Small or emerging businesses which qualify for assistance from the SBIC program can receive equity capital and/or long-term loans from these companies. Essentially, these companies provide their own capital, which is supplemented by federal funds, to the companies they fund.

Interestingly, U.S. taxpayers benefits from the SBIC program as tax revenues generated from successful SBIC investments have more than covered the cost of the program. Likewise the program has created hundreds of thousands of jobs.

In summary, SBA and SBIC financing are viable alternatives to financing from angel investors and venture capitalists and should be considered in the capital raising process. Similarly to angel and VC financing, companies seeking SBA and SBIC financing need a strong management team and value proposition, and a highly professional and compelling business plan in order to raise the capital they need.

Angel Investors: Who They Are & When Are They Appropriate

Angel investors are individuals who invest in emerging business ventures. Angels typically provide both capital and know-how to companies who are in either their start-up or expansion phases. To reflect the increased risk of investing in such firms, angels seek a higher rate of return versus traditional public stock investments.

Angel investors fulfill the financing need that exists between capital provided by friends and family and capital provided by venture capitalists. Individual angel investors often write checks from $25,000 to $100,000. Recently, angel investing has become more organized, and angel groups often invest from $250,000 to $500,000 at a time to deserving ventures.


Angel investors often have similar financing criteria as venture capitalists. They want to see proprietary intellectual property, a large market size, management team members with expertise and experience and a current valuation that allows for a good return on investment.

In identifying and attracting an angel investor, companies should seek angel groups that are located in their region. For instance, the Tech Coast Angels have funded over 85 Southern California-based companies since 1997. When seeking individual angel investors, it is critical to network in order to create a personal connection between yourself and the angel. Also, ideally the individual has experience within your specific field so he/she can provide industry contacts and operational expertise in addition to capital.
